To blow or not to blow? Part 1

I can't tell you how many times people have asked me "should I take a breath test if I am stopped for DUI?" The first thing I tell people is that if you are asked to take a breath then you are already under arrest for DUI. The police cannot ask you to submit to a breath test unless you are already under arrest for DUI. So, don't put yourself in a situation where you ever asked to take a breath test! Good DUI attorneys are very expensive (Not as much for inexperienced attorneys and attorneys that plea everybody out to the standard DUI sanctions) and the other costs of a DUI along with the aggravation and hassle factor are huge.

Before you venture out for an evening that may involve drinking have a plan. Don't wait until you have had five beers before making the decision on whether you are "good to drive". Every client that has ever come into my office has made this decision poorly. That is why they are sitting at my desk writting me a check. So don't write me a check - Have a plan. Everybody has friends and relatives that would be willing to give them a ride. If that isn't possible, I can promise you that a cab (or even a limo) is a lot less expensive than a DUI.
